OFFICE OF INSPECTOR GENERAL

SECTION 1. PURPOSE.

.01This Order prescribes the organization and functions of the Office of Inspector General (OIG) established in the Department of Commerce (the Department) under the Inspector General Act of 1978, as amended, 5 U.S.C. Appendix (the IG Act). The scope of authority and functions of the Inspector General are set forth in Department Organization Order 10-13.

.02This revision updates the Order to reflect the current organization of the OIG.

SECTION 2. ORGANIZATION.

.01The OIG, directed by the Inspector General, is composed of the immediate office of the Inspector General, the Office of Audit and Evaluation, the Office of Investigations, the Office of Administration, and the Office of Counsel. The OIG conducts its operations at headquarters offices located in the Herbert C. Hoover Building in Washington, D.C., and at such regional and field offices as may be established by the Inspector General. The organization structure and line of authority of OIG is depicted in the attached organization chart (Exhibit 1).

SECTION 3. OFFICE OF AUDIT AND EVALUATION.

.01 Organization. The Office of Audit and Evaluation (OAE) will be headed by a Principal Assistant Inspector General (PAIG) who will be responsible for supervising the planning and performance of audits, evaluations, and inspections relating to the programs and operations of the Department and will report and be responsible to the Deputy Inspector General and/or the Inspector General. The PAIG will supervise the performance of all functions and duties assigned to OAE by the Inspector General; will be an advisor to, and serve as representative of, the Inspector General on all audits, evaluations, and inspections; will advise Department officials regarding these audits, evaluations, and inspections; and will represent the OIG with officials of other Federal agencies or other groups regarding these audits, evaluations, and inspections. The PAIG will be assisted by one or more Assistant Inspectors General for Audit and other OAE staff.

a. The functions and duties of OAE will be carried out by such divisions or specialized units as may be established to facilitate the performance of OAE's assigned responsibilities.

.02 Functions. OAE will conduct, supervise, and coordinate audits, evaluations, and inspections of organizational units and activities of the Department and will conduct such other activities as may be assigned to facilitate the accomplishment of the OIG's mission.

SECTION 4. OFFICE OF INVESTIGATIONS.

.01Organization. The Office of Investigations (OI) will be headed by an Assistant Inspector General for Investigations (AIGI), who will be responsible for supervising the performance of investigative activities relating to programs and operations of the Department and will report and be responsible to the Deputy Inspector General and/or the Inspector General. The AIGI will manage the performance of all functions and duties assigned to OI by the Inspector General; will be an advisor to and serve as the representative of the Inspector General on all investigative matters; will advise Department officials regarding OIG investigative matters; and will represent the OIG with officials of the Department of Justice and other Federal agencies or other public or private groups regarding investigative matters covered by the IG Act. The AIGI will be assisted by OI staff.

a. The functions and duties of OI will be carried out by such divisions or specialized units as may be established to facilitate the performance of OI's assigned responsibilities.

.02Functions. OI will conduct, supervise, and coordinate criminal, civil, and administrative inquiries/investigations involving Department programs, operations, funds, and personnel, as authorized by the IG Act; will perform related activities designed to prevent and detect fraud, waste, and abuse; and will conduct such other activities as may be assigned to facilitate the accomplishment of the OIG's mission.

SECTION 5. OFFICE OF ADMINISTRATION.

.01Organization. The Office of Administration (OA) will be headed by a Director of Administration, who will report and be responsible to the Deputy Inspector General and/or the Inspector General.

a.The Director will supervise the provision and management of administrative resources and services to the OIG, and will be the principal advisor to the Inspector General on matters relating to OIG resource management, including planning, information and information technology management, personnel administration and security, budget formulation and execution, and support services; will advise and represent the Inspector General on resource management and administrative matters; will advise Department officials regarding these matters; and will represent the OIG with officials of other Federal agencies or other public or private groups regarding resource management and administrative matters.

b.The functions and duties of OA will be carried out by such offices or specialized units as may be established to facilitate the performance of OA's assigned responsibilities.

.02Functions. OA will be responsible for the provision and management of administrative resources and services for the OIG; will provide budget formulation and execution for sound financial management of the OIG; will administer the OIG's responsibilities relating to employee health and safety and security (personnel, facilities, information, systems, and other resources); will administer the OIG's procurement program; will manage and monitor travel and transportation services for OIG employees; will administer the OIG's human resources function in accordance with the authorities established in the IG Act; will plan for, acquire, secure, control, and manage OIG property; will be responsible for the provision and management of information technology resources and services for the OIG; and will conduct such other activities as may be assigned to facilitate the accomplishment of the OIG's mission.

SECTION 6. OFFICE OF COUNSEL.

.01Organization. The Office of Counsel (OC) will be headed by a Counsel to the Inspector General, who will report and be responsible to the Inspector General. The Counsel will be the legal advisor to the Inspector General and the OIG; will represent the OIG on legal matters; and will represent the OIG with officials of the Department of Justice and other Federal agencies or other public and private groups regarding legal matters.

a.The Counsel may be assisted by other attorneys, who will perform duties and functions as the Counsel may assign; and may perform the duties and functions of the Counsel in his or her absence.

.02Functions. OC will provide legal services to the Inspector General and OIG staff in connection with the activities and operations of the OIG and will conduct such other activities as may be assigned to facilitate the accomplishment of the OIG's mission.

a.The Inspector General will obtain legal advice from OC except that OC may coordinate with the General Counsel for the Department on advice in the areas of ethics laws and regulations.

b.Counsel may consult with the General Counsel for the Department on such legal matters as deemed appropriate.

.03The General Counsel for the Department will respect the independence and integrity of the OIG and the Inspector General will give due regard to the authority of the General Counsel as chief legal officer for the Department.

SECTION 7. EFFECT ON OTHER ORDERS

This Order supersedes DOO 23-1, dated April 26, 2013.
