Department of Commerce Privacy Council

SECTION 1.  PURPOSE.

.01       This Order prescribes the functions of the Department of Commerce (the Department) Privacy Council (the Council).

.02       This revision designates the Chief Privacy Officer (CPO) as the Council’s Chair, adds Privacy Officer representatives from Bureaus and Operating Units to the Council, identifies the Deputy Assistant Secretary for Administration, the Chief Information Officer (CIO), and  the Assistant General Counsel for Administration from the Office of General Counsel (OGC) as Executive Council members, and assigns performance of the Senior Agency Official for Privacy function to the CPO advised by majority vote of Executive Council members.

SECTION 2.  AUTHORITY.

This Order is issued under the authority of 5 United States Code 301 and the Office of Management and Budget Memorandum M-05-08, “Designation of Senior Officials for Privacy.”

SECTION 3.  POLICY.

Trade and commerce in all sector of the economy increasingly depend on transactions that are electronically conducted.  In managing its responsibilities, the Department seeks to maximize the security and confidentiality of the sensitive information with which it is entrusted.

SECTION 4.  STRUCTURE AND OPERATION.

.01       The Council is chaired by the Chief Privacy Officer (CPO) and is comprised of one designated Privacy Officer representative from each Bureau/ Operating Unit.

.02       Executive Council members include the Deputy Assistant Secretary for Administration, the Chief Information Officer (CIO), and the Assistant General Counsel for Administration from the Office of General Counsel (OGC).

.03.    The Senior Agency Official for Privacy (SAOP) function shall be performed by the CPO who shall be advised by majority vote of Executive Council members.

.04       The Council will convene on a regular basis to be determined by the Council’s Chair. Representatives from other Departmental offices and operating units may be invited to participate in meetings based on the agenda.

SECTION 5.  FUNCTIONS.

.01       The Privacy Council works to strengthen Department privacy policies to ensure that they reflect the goals, values, and policies that the Department advocates.  Toward that end, the Privacy Council routinely reviews Department privacy policies and identifies opportunities for strengthening, clarifying, and otherwise improving them.

.02       The Privacy Council identifies and recommends privacy training opportunities for Department employees, as appropriate.
